Convicted county official loses pension fight
CHARLESTON, W.Va. (AP) — A former county assessor convicted in a vote-buying scandal lost an attempt to reclaim his state pension Friday.
The West Virginia Supreme Court affirmed a July 2007 Kanawha County Circuit Court ruling stripping Jerry Weaver, 58, of his pension benefits. The ruling in Kanawha County, where the capital is, upheld a 2006 Consolidated Public Retirement Board decision to revoke the benefits for Weaver’s ‘‘less than honorable service’’ as assessor of Lincoln County.
Weaver pleaded guilty in December 2005 to conspiring to buy votes in numerous elections and was sentenced to a year in jail. When he retired on Jan. 1, 2006, his pension benefits totaled just over $2,000 per month.
In their ruling, the justices clarified the definition of ‘‘less than honorable service’’ in relation to a felony conviction. It must be connected to or associated with the participant’s office or employment, they said.
